The Dauphin County District Attorney's Office has ruled that the deadly officer-involved shooting of Santiago Gutierrez in Harrisburg was justified. On December 10, 2024, police officers shot and killed Gutierrez, a 29-year-old murder suspect, near the Farm Show Complex. The officers believed Gutierrez posed an immediate threat to their safety and the public.
According to the Dauphin County District Attorney's Office, Gutierrez was wanted for the murder of Jhonny Torres on December 8, 2024. On the morning of December 10, police received a tip that Gutierrez was driving a tractor-trailer in the area. Officers attempted to block the vehicle, but Gutierrez rammed a police car and drove toward officers. He then pointed a handgun at them, prompting officers to open fire.
The District Attorney's Office stated that the officers' actions were based on the belief that Gutierrez posed a serious threat. Video evidence from bodycams and the truck's interior supported the officers' decision to use deadly force. The gun Gutierrez used was linked to the murder he was wanted for, although there was no round in the chamber.
The investigation concluded that the officers' use of force was justified under Pennsylvania law. The case is now closed, with no criminal charges filed against the officers involved.
